My question is if the Water(Water4 and normal Water(not Water(Basic)) in Unity 5 is still only for Unity Pro Users or if I can use it, as an Unity personal edition user, for commercial use too.

In Water (Basic)is no underwater sound too.
But are you allowed to use water4 for commercial use with a basic unity license?

You are allowed to use it.

Water4 (Advanced) uses real-time reflections, which were a "Pro only"-feature in Unity3 and 4 as it's using RenderToTexture. Unity5 Personal Edition, however, actually became a fully featured Pro version (function wise). The new Pro version is only of interest for you, if you want to get rid of the Splash screen or if you want to use the Dark skin. Take a look at the Comparison chart >>

For the splosh sound: You'll have to code it by yourself.
