Using DDS, created with NVIDIA Plugin, error "expected 13 found 9"

Hi guys,

I've problems creating DDS files, when i creat them with the nvidia plugin (listed below), i get the error:

Invaild number of mip maps, expected 9 found 5,

than i said "maybe he likes 9"

so i genearted a new mipmap

than i got the same error message but this time with "expected 13 found 9"

I've used this plugin:
http://origin-developer.nvidia.com/object/photoshop_dds_plugins.html

and created following file:
