    Their those had a clause of additional fees, that referenced to other TOS. Like they had a Editor TOS and a "normal" TOS. Their "let me find a lawyer" referenced to that sentence. "See we wrote (even in the old) TOS that we can charge additional fees."

    The TOS Protection was for the Editor TOS, but then they just went and had another TOS, where they added a lot of bullshit. And now they say that the clause in the Editor TOS was not valid and they can change the other TOS.

    For everyone that has read their statements in the past, this is such a bullshit. The Editor TOS says Terms of Service, but does it only reference to the Editor TOS? So if you "loosly" reference to other documents and you can take a big S*** in them, it does only count for them. Everyone assumed this TOS counts for all of their S***.

    Everyone assumed that the protective clause referenced all of their TOS, it even writes TOS. Its such a dickish way to F*** everyone over

    Ah yes, the greatest defence of them all, WORKSFORME WONTFIX. It's also been covered how this change without any developer consultation in the first place is a major breach of trust, especially with their changes to how they're handling the EULA and how they got rid of ways to compare EULA changes.

    They said only one install will count i think

    Q: If a user reinstalls/redownloads a game, will that count as multiple installs?
    A: We are not going to charge a fee for reinstalls. The spirit of this program is and has always been to charge for the first install and we have no desire to charge for the same person doing ongoing installs.

    And if you knew anything about technology or privacy law at all, you'd know that there's absolutely no way to track that.

    Usually publicly traded companies compensate manager-level people (sometimes even mid-managers, but higher usually) in shares and they have the right to sell it even immediately. Obviously the details are subject of negotiations and there are predefined rules how they can trade their own companies so they don't do insider trading.

    No they already said that every install on different devices count as a new install.
    Then you also have to be so naive that there is even a way to detect a first install from a reinstall, and even if they have it they will do so against their own interest because they are very kind to you.

    It doesn't matter since it's a made up number, but, they also said installing on different devices definitely counts as different installs. I have games that I have installed to at least 20 different computers over the years.

    When someone you have an ongoing business relationship with says that they will calculate your bill in secret in a way that you can't plan for or control your level of expenditure, this is them asking for a debit card on your bank account, the right to put liens on your house, take everything you own, and F*** your wife. If you don't understand that, I feel sorry for you. You can't enter into or remain in a business relationship with someone who thinks this is acceptable. It's a sign of total dysfunction.

    Shrugs, if the fact it works better for the vast of majority of people sans a very select type of game isnt good enough for you, there is nothing I can do.

    To me that is just moving the goal post. 'These new terms sucks ass' to 'this term sucks ass in this very particular instance'. And trying to pass that as a absolute.

    That with ignoring all the possible ways things would get better even on that situation.

    And it doesnt make my logic any less valid. I dont see how it is valid for you to say 'F*** me' when I cant say 'no u'.

    My ma once told me I dont actually have to jump off bridges just because people are doing so.

    Thé store that hosts the app/game should pay the fee.
    Ie. Apple, google, steam, etc.

    Problem solved.

    yes but quess who is all alone in the room with unity when their cash runs out and you realize that they can increase their prices the way they want. with those rules in place you do not have a game anymore

    It's really happening. Unity management MUST do something if they want to people to keep using unity!
    This is proof that people really think of switching, and are not only bluffing!

    I personally don't really want to switch, but even if I'm half into battlefield i will NOT pay 1 dolar for reload :p I don;t respons well to blackmail and I will change if Unity doesn't back down AND does something to regain our trust.
    It will hurt me financially and time wise, sure, but i will change engines!

    If you think for a second that a large ongoing concern would consent to this sort of a fee, you're very misled. They would remove unity from all the app stores overnight.

    Turns out Unity can legaly change the TOS aftetall, so this discussion about evil Unity goes nowhere and is meaningless.

    But lets fight capitalism together, so everything can be not just legal, but also ethical lol

    If it sucks for even one single person, it sucks for everyone. It's called "empathy", maybe you should google it.
    Besides, just wait for when they change it to affect you. "And then they came for me, but no one else was left to defend me". Ever heard of it?

    Except you're ignoring the trust issues that I brought up, that multiple people have brought up, as well as the numerous communication problems and the fact they're doing black box calculations to determine installs. You're ignoring how developers are already leaving the engine, including well established ones, because of that.

    You know who all these things affect a lot? Contractors, like me. Like a lot of people. You're trying to act enlightened, but what you're really doing is just going "F*** you, got mine."

    And you know what they'll do? Immediately pass this fee onto the developers instead because they're not going to eat that loss.

    Also possibly install a single game in 20 systems is a rather marginal case.

    With this sort of billing idea, uncapped, we can change how much you owe at any moment, retroactively, without your input or control, you are essentially an unpaid intern making games for Unity Software to monetize as they choose. You live at their mercy.

    You know what? I remember back when the IronSource merger happened that I was having flashbacks to Flash, and predicted that within 8 to 12 years there might not be a Unity editor or runtime. I also remember people thought I was being hyperbolic.

    I didn't think I'd be right *this* fast.

    Yall aint getting killed. Hell most of you said it was already over. So Im just supposed to jump off this bridge so yall feel good?

    Empathy goes both ways. I hope yall make a lot of great games for me to play in the future, no hate here. That doesnt mean I cant wait one week to see the real contract before I jump, none of you is gonna catch me after all.

    Also, yeah, 20 might not be common, but ...4? But also the fact this doesn't have an answer and acts as a random multiplier on sales is part of the problem.

    Concerning Silver Lake, it's a very small portion of their overall holdings.

    Also, all of these transactions, represent small amounts relative to each individual's overall holdings.

    So I doubt this is an SEC-related regulatory/legal issue.

    But what's concerning to me is that the members of the board and the executive team are all selling, not buying.

    so who guarantees that? why not every install counts 5x. i mean they changed it, what stops them from changing it again. they had a TOS that should have prevented them from doing so. but nah

    You can't grant yourself the right to commit fraud via a contract. Things that would be illegal are still illegal even if someone agrees to them in a contract. I know you didn't read the thread, but we've been over this multiple times. In addition, boilerplate contracts or contracts of adhesion such as TOS are essentially not legally binding, especially if they abuse customary trust or norms of business relationships. The idea that you can just try to delete the evidence of assurances that you've given to customers and then retroactively charge them for a benefit you previously granted and they already relied on is a huge legal liability. There will be lawsuits. Of course, it's very difficult and expensive to fight a billion dollar company in court, and they will likely try to delay and bury the plaintiffs in paperwork while calmly stripping the company of all of its assets, because that's how these things go, but they're clearly abusing the inefficiency of the legal and financial systems to try to salvage a belly-up financial situation.

    Yeah sure let's see Jan 1st, there are already scripts made to massively reinstall unity games.
    Oh and don't forget next year when the threshold are pulled out, and everyone is charged from install from the start.

    I was offline, and missed most of the debate, but I am sure there were those saavy enough to know IronSource merger was evil, and I am sure there were many naive enough to defend IronSource.

    Ironically, most of the defenders were probably f2p ad based mobile developers, thinking more money and ads coming their way because of IronSource power.. Whoops. LoL. Useful idiots get lined up against the wall in the end.

    If it keeps up like this, I wonder if it'll end up being abandonware in the next couple of years. Which, of course, would leave it open to anyone to mod it to their liking since there's plenty of stuff that gets made for it all the time (or until this announcement that is).

    With that said, I would feel bad for all the employees that still remain if they end up losing their jobs because of the greed of the bigwigs up top. If there wasn't a better time to consider unionization, it would be now. That is, if they're not already doing that

    Yes, empathy isnt only valid when you agree with someone's actions. Itd be hella easy in that case.

    Only in the internet can you see people telling you to have more empathy while screaming about all the big dongs going on someone's else behalf.

    Yes, sorry for wanting to see the final offer before making a decision involving hopefully millions. Yes, sorry about not joining a bandwagon when things involve my future. Im sorry, pray for my soul or whatever. Or dont and curse me to hell. I aint your dad after all.

    Yeah, I thought about this ... I think the best weapon we "freeloaders" have to get back at Unity is to force them to expend a lot of resources defending their IP. Reverse engineering, ports, mods, export tools, whatever it takes to cut them out of the loop. I'm sure some projects will get cut down, but we have a lot of people who are good at evading liability for this sort of behavior, and it shouldn't be too difficult to figure out how to do it.

    cheap Steam games costing $3, $.2 is about 7 %.

    Steam taking 30%, 7% appears reasonable.

    A $60 game on Pro having <= 100,000 installs per month equals a 0.25 % cut.

    This looks like nothing.


    Unity should have hired a good manager long ago (more for their tech teams (URP/HDRP incompatibility going against development 101 of 30 years ago, at least I believe I've read they made them compatible ie. switchable now (what a switchable SRP should have been in the first place)))

    Unity has been off the rails since most features were not ready for production and a lot were dropped down. I was hoping this to change, but these decisions to make like a lot of games not viable is self destructing. Even a metric based on average income per user, and yearly downloads was better. Unity is the biggest engine for the mobile market... guess what will happen in 2024, almost no game released will be made with Unity.

    So here's a fun one. This means that premium games on mobile will be affected as well since both Google Play and the App Store outright disallow separate demo packages for games. You release a 3 level game on mobile and let people pay to unlock the remaining ones? Congrats, you're paying for those conversions, or lack thereof. Those conversion rates on mobile are pretty damn low too, meaning that you'll likely see lots of games other than just the standard "pay for energy" fare being dinged by this.
