If the hero is Superman, Spiderman or any character created by one of those companies, or anyone else, then you will need the permission of the copyright holder (good luck getting it, though).

Im making a super hero game right now! It's 1:20 AM and I have been working for three hours..... I want to release before february on google play......

anywayyyyyyys...... read Blacklight's comment. It will be hard to get a license to make a hero game, especially since you are a growing developer. Try making some other games first or maybe create a super hero. Try to get out there and then maybe ask for a license. Good luck :)

To clarify, there is no point in asking for permission or a license.
If you want to produce a Marvel game for example, to get a license you would first have show that you have a solid game, and there is a market for it, and doesn't compete with other Marvel games. If you can demonstrate that you are able to complete game and bring it to market. If all that is there and approved, you will then pay a license fee, and agree other terms and/or sales percentage/etc for using the content. The license fee is not trivial.

Yes, you can ask for permission, but you have to prove you can deliver and pay a lot of money for it.

Well, are you using one of their characters?

Regardless of who the creator is, if you're using something made by someone else then you need their permission. If it's your own character that just happens to be a superhero then you should be fine, though, I don't believe the general concept of "person with special powers" can be owned.
