Is Unity3d rules changed? its still open source?

    i just watched in unity3d rules that saying "if your using unity3d for hobby not for commerical then unity3d is free"
    so this made me think because i wanted to use unity3d as indie developer where i create game and sell for free without any charge so it still exist ? or i need to pay for them? in new in unity5.3

    It is free to use, unless you're making more than $100,000 with it (last I checked). You can use it and sell your games for [a price] or release them for free. It's not open source and never was (apart from a few bits of it here and there, such as the UI system).
